These Terms of Use ("Terms") govern your access to and use of the website sortmyloan.com (the "Website") and the services offered through it (the "Services") provided by SortMyLoan.com ("SortMyLoan," "we," "us," or "our"). By accessing or using the Website or Services, you agree to be bound by these Terms.

PLEASE READ THESE TERMS CAREFULLY. They include important provisions such as a binding arbitration clause and class action waiver (Section 14). If you do not agree to these Terms, do not use the Website or Services.

1. What SortMyLoan Is

SortMyLoan operates a loan-matching service that connects U.S. consumers with a network of independent third-party lenders and lending partners. SortMyLoan is not a lender. We do not make credit decisions, do not extend credit, do not determine loan terms, and are not a party to any loan you may obtain through a lender in our network.

Our role is limited to receiving your loan request and sharing your application with lenders in our network so they can determine whether to extend you an offer. Each lender independently evaluates applications based on its own criteria and is solely responsible for any loan it offers, originates, or services.

2. Eligibility

To use the Services, you represent and warrant that you:

• Are at least 18 years of age (or the age of majority in your state, whichever is older)
• Are a legal resident of the United States with a valid Social Security number
• Have the legal capacity to enter into a binding contract
• Are not prohibited by law from using a loan-matching service
• Will provide accurate, current, and complete information when submitting a loan request

We may decline to provide our Services to anyone for any lawful reason, at our sole discretion.

3. The Loan Request Process

When you submit a loan request through the Website, you authorize SortMyLoan to share your application with lenders and lending partners in our network. The submission of a loan request through SortMyLoan is not a guarantee of approval or any specific loan terms.

Following submission:

• Lenders in our network independently review your application based on their own underwriting criteria
• If a lender extends an offer, you will be directed to that lender's website or contacted by the lender directly
• Acceptance of any loan offer is a separate transaction governed by the lender's own loan agreement and disclosures
• Your relationship with any lender is between you and that lender — SortMyLoan is not a party to any resulting loan

4. No Lending Decisions or Loan Terms by SortMyLoan

Because SortMyLoan is not a lender, we do not:

• Make any decision about whether you will be approved for a loan
• Determine the loan amount, APR, fees, term, or any other terms of any loan
• Make any representations or guarantees about the availability of loans or specific terms
• Service, collect on, or modify any loan once originated

APRs and other loan terms vary widely by lender, by state, by your credit profile, and by other factors. Compare offers carefully before accepting any loan. Consider whether a short-term loan is appropriate for your financial situation.

5. Information You Provide

You agree that:

• All information you submit through the Website is true, accurate, current, and complete
• The Social Security number and other identity information you provide are your own and were provided lawfully
• You have the right to authorize the sharing of this information with lenders and our service providers
• You will update your information promptly if it changes

Submitting false, inaccurate, or fraudulent information may constitute a federal or state crime, including under 18 U.S.C. § 1001 (false statements) and related statutes.

6. Communications and TCPA Consent

By submitting a loan request, you consent to receive communications from SortMyLoan and from lenders and lending partners we share your application with, including calls, text messages, and pre-recorded or artificial voice messages, at the phone number you provide. This consent applies even if your phone number appears on any federal, state, or internal Do-Not-Call list.

Standard message and data rates may apply. Consent to receive these communications is not a condition of obtaining a loan. You may revoke consent at any time by emailing info@sortmyloan.com.

7. Account Security

You are responsible for safeguarding any access credentials or session identifiers associated with your use of the Website. You agree to notify us immediately of any unauthorized use or access to the Services.

8. Permitted and Prohibited Uses

You agree NOT to:

• Use the Services for any purpose that is unlawful, harmful, fraudulent, or infringes the rights of others
• Submit information about anyone other than yourself, except where you have explicit authorization
• Use automated means (bots, scrapers, crawlers) to access the Website except as expressly permitted
• Attempt to reverse engineer, decompile, or otherwise extract the source code of any part of the Website
• Interfere with or attempt to disrupt the operation of the Website, its servers, or its security
• Misrepresent your identity or affiliation with any person or entity
• Use the Services to harvest information about other users

9. Intellectual Property

All content on the Website, including text, graphics, logos, icons, images, software, and the compilation thereof, is the property of SortMyLoan or its licensors and is protected by United States and international copyright and other intellectual property laws.

10. Disclaimers

THE WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the maximum extent permitted by applicable law, SortMyLoan disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.

We do not warrant that any lender in our network will offer you a loan or offer terms you will find acceptable. We do not warrant that the Website will be uninterrupted, secure, or error-free, or that defects will be corrected.

We make no representations or warranties about the practices, policies, or services of any lender in our network. Any loan you obtain through a lender is governed by that lender's own terms and disclosures.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SORTMYLOAN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES arising out of or relating to your use of the Website or Services, including but not limited to loss of profits, data, business opportunities, or goodwill, even if SortMyLoan has been advised of the possibility of such damages.

In no event shall our total liability to you for all claims arising out of or relating to these Terms or your use of the Website or Services exceed one hundred U.S. dollars (USD $100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full. In such cases, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless SortMyLoan and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Website or Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any information you submit to us.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflicts of law principles. Any dispute not subject to arbitration under Section 14 shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts.

14. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Agreement to Arbitrate. You and SortMyLoan agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or the Services (each, a "Dispute") shall be resolved exclusively through final and binding arbitration, rather than in court, except as provided below.

Class Action Waiver. You and SortMyLoan agree that each may bring claims against the other only on an individual basis and not as a plaintiff or class member in any purported class, collective, or representative action.

Arbitration Procedures. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be held in Delaware or, at your election, in your county of residence within the United States.

Exceptions. Either party may bring claims in small claims court if they qualify, and either party may seek injunctive relief in court to prevent the actual or threatened infringement of intellectual property rights.

Opt-Out. You may opt out of this arbitration agreement within 30 days of first agreeing to these Terms by emailing info@sortmyloan.com with the subject line "Arbitration Opt-Out" and your full legal name and address.

15. Modifications to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and may notify you by email or through a prominent notice on the Website. Continued use of the Website or Services after a change constitutes your acceptance of the updated Terms.

16. Termination

We may terminate or suspend your access to the Website and Services at any time, with or without notice, for any reason or no reason, including for violation of these Terms. Upon termination, your right to use the Services ceases immediately. The provisions of these Terms that by their nature should survive termination shall survive, including Sections 9, 10, 11, 12, 13, and 14.

17. Miscellaneous

These Terms, together with our Privacy Policy and any other terms incorporated by reference, constitute the entire agreement between you and SortMyLoan regarding your use of the Website and Services. If any provision is found to be invalid or unenforceable, the remaining provisions remain in full force and effect. No waiver of any provision shall be deemed a continuing waiver.

We may assign these Terms to a successor or affiliate without your consent. You may not assign these Terms without our prior written consent.
